The general terms and conditions define the rules and conditions governing the use of our services and products. They specify the rights and obligations of each party, to ensure a transparent and secure relationship between our company and our customers. By accessing our services, you agree to these terms, which are designed to protect your interests and provide you with the best possible experience.

CORPORATE IDENTITY

Company presentation

MuralConcept is part of the Picturalp'design group, registered in Annecy under number 884 606 781 and located at 400 route de l'aiglière ZI Fier, Argonay 74370. On its website www.muralconcept.fr, the Company, under its trade name MuralConcept, offers a catalog of products specializing in wall decorations, and more particularly wallpapers customized to the dimensions ordered by the customer. The customer is provided with all the information required to place an order, and is supported by telephone or e-mail to assist in the purchasing process. The sale between the Customer and the Company will only be completed once the Customer has accepted the General Terms and Conditions, at the time of validating his/her basket, before proceeding to payment.

Product pricing

The prices of products sold through the website are indicated in euros, all taxes included, excluding shipping costs, and are precisely determined on the product description pages. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Vendor. They are the responsibility of the purchaser (declarations, payment to the competent authorities, etc.). In this respect, the Seller invites the purchaser to obtain information on these aspects from the relevant local authorities. The Company reserves the right to modifier its prices at any time in the future. Any telecommunication costs incurred in accessing the Company's websites shall be borne by the Customer. Delivery charges, if any, are also payable by the Customer.

Site products

The products presented on the site are in the category: Wallpapers. Each product is presented with its technical specifications and options. They are offered while stocks last, and are made to order. The colors shown in the photos are not contractual and may not match, due to different screen resolutions (computer, laptop). The Company cannot be held responsible for these differences due to the quality of the screens or the different baths of the products. These General Terms and Conditions of Sale (GTCS) govern the sale of Products effected through the Company's website, and are an integral part of the Contract between the Buyer and the Seller. They are fully enforceable against the Buyer who has accepted them before placing an order. The Vendor reserves the right to modifier these terms and conditions at any time by publishing a new version on its website. The GCS applicable at that time are those in force on the date of payment (or of the first payment in the case of multiple payments) of the order. These GCS can be consulted on the Company's website at the following address: www.muralconcept.fr. The Company also ensures that their acceptance is clear and unreserved by setting up a checkbox and a validation click. The Customer declares that he/she has read the present General Terms and Conditions of Sale, and any Special Terms and Conditions of Sale relating to a product, and accepts them without restriction or reservation. The Customer acknowledges that he/she has bénéficié of the advice and information necessary afin to ensure the suitability of the offre for his/her needs. The Customer declares that he/she is legally able to contract under French law or validly represents the individual or legal entity for which he/she is contracting. In the absence of proof to the contrary, the information recorded by the Company constitutes proof of all transactions.

ORDERING AND CONCLUDING THE SALES CONTRACT

Control

In accordance with the provisions of article 1127-1 of the French Civil Code, the Customer must follow a series of steps to conclude the contract by electronic means, in order to be able to complete the order: Creation of a customer account Information on the essential characteristics of the Product; Choice of the Product, and its options (size, color) Indication of the Customer's contact details (identification, email, address...) Acceptance of the present General Terms and Conditions of Sale Verifification of the elements of the order and, correction of errors. Before proceeding with confirmation, the Buyer has the opportunity to check the details of the order, its price and delivery time, and to correct any errors or cancel the order. Validation of the order will result in the formation of the present contract. The Customer will then follow the payment instructions, pay for the products, and choose the delivery method for the order. The Customer will receive confirmation by e-mail of the payment of the order, as well as an acknowledgement of receipt of the order confirming it. The order date is the date of validation of the order, which may take several days depending on the payment method used. The language of the contract is French. The terms of the offre and general conditions of sale are returned by email to the buyer when the order is placed and archived on the Seller's website. Where applicable, the professional and commercial rules to which the author of the offre intends to abide can be consulted in the footer and are available on the Seller's website at www.muralconcept.fr. The archiving of communications, orders, order details, as well as invoices is effected on a fiable and durable medium so as to constitute a fidèle and durable copy in accordance with the provisions of Article 1360 of the Civil Code. This information may be produced as proof of the contract. For delivered products, delivery will be made to the address indicated by the Customer. In order for the order to be processed correctly, the Customer undertakes to provide truthful identification details. The Vendor reserves the right to refuse the order, for example in the case of any abnormal request, made in bad faith or for any legitimate reason. In the event of unavailability of an ordered Product, you will be informed by e-mail. If you have any questions concerning the follow-up of an order, you can contact us by e-mail (contact@muralconcept.fr) or by telephone, Monday to Thursday, 9.30am to 5.30pm and Friday, 9.30am to 12pm.

Order cancellation

In the event of cancellation of an order by the customer: an indemnity equal to or greater than 50% will be retained by La Société. It may reach 100% of the price if the products have been specially manufactured for the customer: custom-made wallpaper. In the event of cancellation with partial reimbursement, the reimbursement period will not exceed thirty days from the date of acceptance of the cancellation by La Société.

Time limits and right of withdrawal

In accordance with article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to products customized or transformed to the customer's specifications, particularly when production of the product has already begun (between 24 and 48 hours after order validation).

We therefore invite you to take the time necessary to take your measurements and choose the ideal visual. MuralConcept wallpapers are custom-printed according to the customer's dimensional specifications. Under these conditions, they cannot be offered for sale.

Payment

The price is payable at the time the order is placed. Depending on the date of the order, a bank account debit request will be sent to the buyer's bank within 3 days. The order will be considered final after approval by the payment center. On-line payments will be made via a secure system, so that the information transmitted remains encrypted and no third party can gain knowledge of it during transfer on the network. It is the purchaser's responsibility to save and print out his/her payment slip if he/she wishes to retain details of the banking operation relating to the transaction. At the purchaser's request, a paper invoice will be sent, showing VAT.

You can pay for your order by credit card (Carte Bleue, Visa, Mastercard, American Express). Your account will be debited as soon as your bank or payment center agrees. Via your PAYPAL account, by choosing payment via PayPal, you will automatically be directed to your PayPal account. In the case of payment by cheque, the order will only be validated on receipt of the cheque, on the back of which the Customer will have indicated the corresponding order number. European Union and non-European Union VAT

VAT European Union

In each country belonging to the European Union, there are sales thresholds that must not be exceeded when invoicing a private customer. Up to the sales threshold of the European Union country, the VAT applicable is that of France. Above the EU sales threshold, the VAT applicable is that of the country receiving the goods.

VAT outside the European Union

You are exempt from VAT when invoicing a private or professional customer. We inform you that any particularities of payment will be studied on a case-by-case basis and in accordance with current legislation, including delivery charges. Deliveries outside the European Union must be requested in the first instance via the contact page.

DATA PROTECTION AND INTELLECTUAL PROPERTY

Personal data protection

MuralConcept, as the Data Controller, undertakes to comply with the provisions of Law No. 78-17 of January 6, 1978 as amended relating to data processing, files and freedoms with regard to the automated processing of personal data carried out as well as Regulation (EU) No. 2016/2006/679 of April 27, 2016 from its application on May 25, 2018. When you place an order, the personal data collected will be subject to computer processing. You are invited to refer to our Privacy Policy section of the Website for all information relating to this point.

Intellectual property

All elements of the Website are and remain the exclusive intellectual property of MuralConcept. No one is authorized to reproduce, exploit, distribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Product under license Warner Bros (Harry Potter, looney...) N°583004. Resale authorization on behalf of Adawall. Framing and in-line linking techniques are strictly prohibited.

DELIVERY

Delivery methods and costs

Delivery rates are visible when updating the product basket. The corresponding delivery time is indicated for Metropolitan France on the product sheet and in the basket. We send our parcels, depending on locality, with the following carriers: Colissimo, Chronopost, DPD or DHL.

Delivery times

MuralConcept undertakes to dispatch orders as quickly as possible. The average delivery time is between 10 and 15 working days from the order validation date. Delivery times may sometimes exceed the average by a few days in the event of events beyond our control, such as bad weather, carrier error or temporary overloading of our production workshops. The majority of our products are made-to-measure, and require time to manufacture and prepare. During sales operations such as sales, our production workshops may have difficulty processing all orders within the allotted time. This lead time will never exceed 30 days.

RETURNS AND CLAIMS

Returns and refunds

All products supplied are covered by the legal warranty stipulated in article 1641 et seq. of the French Civil Code. In the event of non-conformity of the product, it may be returned to us for exchange or refund. All claims for lack of conformity, requests for exchange or refund must be made within fourteen days after the date of delivery, by notifying us by e-mail at contact@muralconcept.fr and by returning the product by post to the following address:

Any product accepted for return but damaged on arrival at MuralConcept will not be reimbursed. If its condition renders it unfit for sale, you will be informed as soon as possible.

Claim

It is your responsibility to check the conformity of the goods before they are installed, whether by a professional or not. Wallpaper defects discovered after installation cannot be claimed. Under no circumstances will the cost of installation by a professional or service provider be claimed. Any claim based on non-conformity of the products delivered or on an apparent defect must be sent within fourteen days of receipt of the goods to contact@muralconcept. Once the products have been installed, they will be deemed accepted and recognized as conforming.

If you notice a defective product, it is essential to send us a photo of the box and the product by e-mail to contact@muralconcept.fr.

All complaints must be made before the product is installed. We remind you that installation of the product constitutes acceptance as is. It is essential to check your wallpaper before installing it to avoid any problems and to judge the product as it is. We will not be able to respond favorably to a complaint concerning wallpaper handled by a third party. Wallpaper is subject to modification during installation.

Transport damage

MuralConcept advises you to check your parcel upon delivery. The Customer or his representative must inspect the goods in the presence of the duly authorized carrier. In the event of damage due to transport, the Customer, as the recipient, must expressly notify the carrier of the reservations to be made within the allotted time, and send a copy to MuralConcept, failing which MuralConcept reserves the right to refuse the return, refund or replacement of the products.

Product preservation

MuralConcept will not be obliged to keep for the customer products paid for but for which a delivery address has not been given or is incorrect. In this case, after a period of 3 months, the products will be put back on sale and the price retained by MuralConcept. The Company cannot be held responsible if delivery cannot be made for reasons of accessibility or absence of a person to receive the products. Products returned to MuralConcept for delivery error or absence of the addressee will be resent at the exclusive expense of the Customer, and according to his written terms.

Before placing your order, we invite you to take all the necessary steps (choice of model, size, appearance, colors, purchase of sample) to ensure that the wallpaper you receive corresponds to your expectations.

PRODUCT AND LIABILITY

Limitation of liability

MuralConcept's liability is strictly limited to the value of goods found to be non-conforming, defective or faulty, without compensation of any kind and for any reason whatsoever.

Liability waiver

MuralConcept declines all responsibility for the improper use or misuse of products ordered by the customer. The Company is in no way responsible for the consequences resulting from: storage of products in abnormal conditions or conditions incompatible with their nature, their transformation, failure to follow installation instructions, abnormal wear resulting from poor maintenance or imperfect installation, deterioration of products due to water infiltration, impact or inappropriate use, temperature or humidity levels.

Bonds

MuralConcept has an obligation of result for all stages of the order process and for all stages subsequent to the conclusion of the contract. The Company therefore undertakes to describe the Products sold on the Website as accurately as possible. However, La Société shall not be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French case law. Likewise, the Company shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses. The Company retains ownership of the products delivered until full payment has been received from the Customer. Transport risks will be borne by the customer as soon as the products are dispatched. In cases of force majeure, transport strikes, road blockages, natural disasters or impossibility of movement, the company will not be held responsible for late or non-delivery.
